Terms of Service

1.Who we are

Levay ("Levay", "we", "us") runs this website, the dashboard and the Levay apps. You can reach us at legal@levay.xyz.

These terms apply to levay.xyz, the Levay dashboard, the public community shop pages and the Levay apps for Discord and Slack (together, the "Service").

2.Agreeing to these terms

By creating an account, adding Levay to a Discord server or Slack workspace, or using the Service in any other way, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you add Levay on behalf of a community, company or other organisation, you confirm that you are allowed to do so, and these terms apply to that organisation too.

You must be old enough to use Discord or Slack in your country (at least 13, or older where local law requires) and able to accept these terms. You are responsible for making sure that using Levay is allowed where you live.

3.Early access

Levay is in early access. Sign-up is by invite, features can change or be removed, and the Service may sometimes be unavailable. We will try to tell you in advance about changes that affect you.

4.Your account

Give true and complete information when you sign up. We may refuse, suspend or close an account set up with false or misleading information.
Use an email address you control, choose a strong password and keep it to yourself.
You are responsible for what happens in your account. Tell us at once if you think someone else has access or your details were leaked; we are not liable for losses caused by sharing or not protecting your sign-in details.
One account per person. Do not share accounts or sell access.
You can have your account deleted at any time: write to support@levay.xyz from the email on the account. See the Privacy Policy for what happens to your data.

5.Adding Levay to Discord or Slack

You need the right permissions to add Levay (Manage Server in Discord, or a workspace admin or owner in Slack). By adding it, you confirm that your community allows it.

Community admins decide how Levay is set up in their community: the currency, allowances, levels, messages, shop and rewards. Admins are responsible for that setup and for letting members know Levay is used there. We do not control who joins a community or what its admins and members do with Levay.

Levay is an independent app. It is not made, endorsed or supported by Discord Inc. or Slack Technologies, LLC, and does not act on their behalf. Discord's and Slack's own terms and policies also apply to your use of Levay on those platforms.

6.Currency, XP and rewards

Each community has its own currency (for example ⭐ or 🌮), XP and levels. They are a way to say thanks. They are not money.

The currency has no monetary value. It cannot be bought, sold, exchanged for money or anything else of value outside Levay, or transferred between communities. Any attempt to do so is void.
Balances, XP and levels are not your property. Community admins and Levay may adjust or reset them, for example to fix abuse or a mistake. They are lost if the community removes Levay or your account is closed for breaking these terms, with no compensation.
Rewards in a community shop are offered and fulfilled by that community's admins. Levay provides the tools but is not a party to those exchanges and does not guarantee them.
Questions about an order, delivery or refund go to the community's admins first. Instant items (roles, codes, content) are delivered at once and usually cannot be returned.
Promo codes in a community shop work only as their community sets them up: for the products, dates and number of uses shown.

7.Acceptable use

Use Levay only for what it is made for, within these terms and the law. Do not use Levay to:

spam, harass, threaten, offend or deceive people, including through message templates or shop items;
post illegal content, content that infringes someone else's rights (such as copyright or trademarks) or content that breaks Discord's or Slack's rules;
farm currency or XP with fake accounts, bots or scripted thanks;
access the Service with bots, scrapers or other automated tools, other than through Discord, Slack and the interfaces we provide;
break, overload or get around the limits of the Service, introduce malware, or exploit bugs instead of reporting them;
copy, modify, reverse-engineer, decompile or try to extract the source code of Levay;
resell, rent out or otherwise commercially exploit the Service without our written permission;
sell real-world goods to people who did not agree to it, or collect personal data you are not allowed to.

If these rules are broken, we may remove content, limit or remove Levay from a community, suspend or close an account, and report illegal activity to the authorities. Where we can, we will tell you why.

8.Levay's software and brand

Levay - the software, the website, its design and texts, the name and the logo - belongs to us or our licensors. We give you a personal, limited, non-exclusive, non-transferable licence to use the Service under these terms, for as long as you use it. Nothing is sold to you, and every right we do not expressly give you stays with us.

You may not copy, republish, sell or build on the content of the website, except where the law allows it or where we say so.

9.Content you add

You keep ownership of what you add to Levay: message templates, level names, product names, descriptions and photos. You give us a free, non-exclusive permission to store, display and process it only to run the Service for you and your community.

Only add content you have the right to use. You are responsible for it, and you agree to cover our losses if someone makes a claim against us because of it.

We do not review content before it appears, but we may remove or block it, without notice or compensation, if we receive a complaint or a notice that it infringes someone's rights, if an authority orders it, or if it puts people or the Service at risk.

10.Other services

Levay runs on Discord and Slack and may link to other sites (for example, a link in a community's message or shop item). We do not control them and are not responsible for their content or availability; their own terms apply.

11.Fees

Levay is free to use during early access.

12.Ending your use of Levay

You can stop at any time: remove the bot from your server or workspace and ask us at support@levay.xyz to delete your account.

We may stop providing the Service, or end your access, with reasonable notice. We may suspend or end access without notice if you break these terms, if the law or an authority requires it, or if we suspect fraud or a security problem with your account. If we stop the Service as a whole, we will help you get your data out as the law requires. What happens to the data is explained in the Privacy Policy.

When your access ends, your licence to use Levay ends too.

13.Availability

We may pause the Service for maintenance and updates, and will tell you in advance when we can. It may also be unavailable for reasons outside our control, such as outages of Discord, Slack or our providers.

14.Disclaimers and liability

The Service is provided "as is" and "as available", and you use it at your own risk. We do our best to keep it working and secure, but we do not promise it will be uninterrupted, error-free or never lose data, or that it suits a particular purpose.

To the extent the law allows, Levay is not liable for indirect or consequential losses (such as lost profits, goodwill or data), for lost currency, XP or rewards, or for what community admins, members or other services do. Where we are liable, our total liability is limited to what you paid us for the Service in the 12 months before the claim.

You agree to cover our losses and costs from claims made against us because you broke these terms or the law, or infringed someone else's rights.

Nothing in these terms limits rights you have as a consumer that cannot be limited by law. Some places do not allow some of the limits above, so they may not apply to you.

15.Changes to these terms

We may update these terms. If a change matters, we will tell you by email or in the dashboard before it takes effect. Changes apply only from then on; the previous version applies to the time before, and we will send it to you on request. If you keep using the Service, you accept the new terms; if you do not, stop using it and you can have your account deleted. The date at the top shows the latest version.

16.General

These terms and the Privacy Policy are the whole agreement between you and us about the Service.
If part of these terms cannot be enforced, the rest still applies, and that part is read as closely to its purpose as the law allows.
If we do not enforce a rule at once, we do not give up the right to enforce it later.
You may not transfer your rights under these terms without our written consent. We may transfer them, for example if Levay is sold or reorganised.
We may send you notices by email, in the dashboard, or through Levay in Discord or Slack. Product news only if you opted in.
These terms are written in English. Section titles are only for convenience.

17.Disputes

If something goes wrong, write to us first at legal@levay.xyz with a short description and, if it helps, your account or community. We will try to resolve it with you and reply within 21 days. This does not take away your right to go to court or to a consumer body.
